We’re starting with the origin of cannabidiol. This is because origin plays the main role in legal status and FDA guidelines on CBD.
Origin of CBD
Cannabidiol can come from cannabis or marijuana, as well as hemp plants. The cultivation of marijuana plants are in controlled and carefully managed conditions. Hemp plants are grown in the outdoors to increase the yield and size of the plants.
Moreover, marijuana plants are bushier and shorter, whereas hemp plants are skinner and taller. Besides this, they also differ from each other in several other aspects. If you want to know these aspects, read our next subheading. We’re covering all these aspects there.
Difference between Marijuana-Derived and Hemp-Derived Cannabidiol: A Legal View
Here, we’re going to discuss why the legal status differs for hemp CBD and marijuana CBD.
Marijuana-derived CBD
Marijuana CBD is rich in THC content and very low in CBD content. In fact, cannabis plants contain more than 0.3% THC content. Now, when it comes to the legal status of CBD, marijuana-derived is illegal federally. This is because, as per the federal law, cannabis with 0.3 % or more than 0.3% THC content is illegal.
Moreover, according to DEA, it comes under the list of Schedule I Drugs. These drugs are not for medicinal purposes. Additionally, marijuana-derived CBD with 0% THC content is also illegal federally. This is only because of its origin.
Hemp-derived CBD
As we mentioned earlier, hemp CBD is rich in cannabidiol content and very low in THC content. In fact, hemp plants contain less than 0.3% THC content. This is the reason why Farm Bill approved the cultivation of this plant all over the U.S.
As per the Farm Bill 2018, industrial hemp is no longer in the list of Schedule I Drugs. As a result, hemp-derived CBD products are federally legal. However, some states have their own rules and regulations when it comes to cannabidiol products.
Note: If you want to purchase any cannabidiol product, study what your state law is saying about CBD and its usage.
FDA Guidelines on CBD
Here, we’re going to discuss several important aspects of cannabidiol on the FDA (Food and Drug Administration).
Farm Bill 2018 Act – The Act that Made the CBD Products Popular
Hemp plants are a variety of Cannabis sativa L. plants, which can be useful for food and textile products. The cultivation of these plants is easy, and it grows very fast. These plants contain a high amount of cannabidiol, which has many health and wellness benefits. In fact, hemp and its products contain very less amount of THC. However, still, until 20th December 2018, hemp comes under the category of Schedule I substances. This means hemp was illegal to cultivate and sell federally.
On December 20, 2018, President Trump signed the Farm Bill 2018. The bill is also popular as Agricultural Act of 2018. This bill permits cultivation, as well as the sale of hemp federally. This law became effective from January 1, 2019. It is because the Agricultural Act 2018 consider hemp as the Cannabis Sativa L. with less than 0.3% THC content. Moreover, the act removes the hemp plants from the Controlled Substance Act. As a result, the farming, possession, and sale of hemp and its derivatives have become legal.
Does the FDA Approve any Cannabis or Cannabis-sourced CBD Product?
Until now, the FDA doesn’t approve to market any cannabis product for medical purposes.
However, the FDA approved a cannabidiol-based drug, namely Epidiolex. This drug can help treat two rare medical conditions of Epilepsy. The two rare medical conditions are Dravet Syndrome and Lennox-Gastaut Syndrome. These health problems usually occur in the childhood days. This is because the FDA considers this drug as a safe choice to treat these two childhood disorders.
Along with this, the FDA also gave approval to three cannabis-related medicines. The name of these medicines is Marinol, Syndros, and Cesamet.
Syndros and Marinol are for treating anorexia allied with weight loss in people having AIDS. These two drugs have dronabinol as the active ingredient. Dronabinol is basically a synthetic delta-9- THC (a psychoactive compound of cannabis). In addition to these two drugs, the third FDA-approved medicine is Cesamet. This drug contains nabilone as the main ingredient. The chemical structure of nabilone is the same as THC.
Why FDA Doesn’t Gave Approval To More Cannabis Or Cannabis-Derived Products?
As of now, researches are going on to find out the effectiveness of cannabidiol in treating all the diseases. Not only this, but the researches are also going on to find out how safe it is. It means still the researchers are not sure that cannabis and cannabis-derived products are safe. This is why the FDA doesn’t give approval to more cannabis or cannabis-derived products.
Is It Legal to Sell CBD-infused Products in Your State?
The answer to this question might vary for every state. It strictly depends on the label and intended use of the product. Moreover, even if the product is pure hemp-derived cannabidiol product, it should comply with your state law.
In fact, still now, the communications regarding cannabidiol are going on between the local and state officials. The communication is mainly to answer the questions regarding the requirements under the Federal Food, Drug, and Cosmetic (FD, & C) Act. This can help to understand the scenario of cannabidiol at the state level.
Future of CBD
Currently, when it comes to cannabidiol, there are several misconceptions. This includes its medical benefits and legality.
However, as the benefits of cannabidiol are accepting widely, more studies are taking place on this. In some states, cannabidiol is legal to use, but at the same time, some states consider it as an illegal substance.
